Amber, there is a point of contact within the client's corporate office that handles these situations and that is why I am not too concerned. As you mentioned, perhaps there was a error or a disconnect between the hiring manager and HR and I agree with not throwing legal at the company without first communicating the issue. It appears that the hired candidate is not aware of this issue and is reaching out to me because of the experience he/she had throughout the process. I will let you guys know when this issue is resolved.
Josue, does your legal department automatically make first contact in these situations? If this person is reaching out to you to work on positions, is there a possibility that there was an error somewhere and throwing legal at the company is going to be aggressive when a simple fix might be available?
Just be upfront with them.
