Third Party Recruiting Question regarding candidates/contractual obligations

I have a question that I hope you can help me answer for one of my hiring managers.

I know that companies sign contracts with third party recruiters, but do candidates as well?

Please advise me.

Thanks!

Lynn

Hi, Lynn! You usually a contract is with the client and the third party company. Is the candidate a H1? In the contract with the client and the third party is does include that person name and role. I hope this helps.

If you are wondering about candidates recruited for full time roles - the answer would be NO. If these candidates are being considered for contract positions at your clients then they WOULD sign a contract regarding pay, expectations, non-competition, etc.

Sometimes yes. Non Compete Agreement/ Understanding. This is to secure the thrid party vendor. Some clients try to skip the third party and go directly to the candidate, or vice versa. To overcome such unethical practices the third party vendor needs sign a non compete agreement with the consultant too.
